Terms of Service

By accessing or using Dagur, you ("you," "user") agree to these Terms of Service ("Terms") with the operator of Dagur ("we," "us," "Dagur"). If you do not agree, do not use the service.

1. Who we are

"Dagur" ("we", "us", "our") is the operator of the service described in these Terms. Contact: hello@dagur.co. Full operator details are available on request.

2. The service

Dagur is a browser-based new-tab dashboard with optional cloud sync, AI features, and third-party integrations. We provide the service on an "as-is" basis. We make reasonable efforts to maintain availability but do not guarantee uninterrupted, error-free service.

3. Eligibility and account

  • You must be at least 16 years old to use Dagur. If you are under 16, do not use the service
  • You are responsible for keeping your password secure and for all activity under your account
  • One account per person. You may not share credentials
  • You must provide accurate information when creating an account
  • We may suspend or terminate accounts that violate these Terms or applicable law

4. Acceptable use

You agree not to:

  • Use Dagur to violate any law, regulation, or third-party right
  • Upload or transmit content that is unlawful, harassing, defamatory, or infringes intellectual property
  • Attempt to reverse-engineer, decompile, or circumvent the technical limitations of the service
  • Scrape, abuse rate limits, or interfere with the operation of the service
  • Use the service to transmit malware, spam, or phishing content
  • Resell, sublicense, or commercially exploit the service without our written permission
  • Use automated systems to access the service in a manner that exceeds reasonable individual use

We may, at our sole discretion, remove content or suspend accounts that violate this section.

5. Subscriptions, billing, and refunds

  • Plans. Pro and Founder tiers are paid subscriptions billed monthly or annually through Stripe
  • Auto-renewal. Subscriptions automatically renew at the end of each billing cycle until canceled. You can cancel any time from the Customer Portal
  • Cancellation. You retain access for the remainder of the paid period. We do not pro-rate partial months
  • Refunds. If you are unsatisfied within 14 days of your initial purchase, email hello@dagur.co and we will issue a refund. Outside that window, refunds are at our discretion
  • Failed payments. If a charge fails, we will retry and notify you. We may suspend Pro features after a reasonable grace period
  • Price changes. We may change prices for new subscribers at any time. Existing subscribers keep their current rate for the remainder of their billing period; we will give at least 30 days' notice before price changes apply to renewals
  • Taxes. Prices may exclude applicable VAT or sales tax, which will be added at checkout where required

6. Your content

You retain ownership of any content you create, upload, or store in Dagur ("Your Content"). You grant us a limited, non-exclusive, royalty-free license to host, store, transmit, and display Your Content solely as needed to provide the service to you. We do not claim ownership of Your Content and do not use it to train AI models.

You represent that you have all rights necessary to grant this license and that Your Content does not infringe the rights of any third party.

7. AI features and disclaimer

Dagur uses third-party AI providers (including Anthropic and OpenAI) to generate responses. AI output:

  • Can be inaccurate, incomplete, biased, or out-of-date
  • Should not be relied upon for medical, legal, financial, safety-critical, or other professional decisions
  • Is generated probabilistically — different prompts or runs may produce different results

You are solely responsible for verifying AI output before acting on it. We disclaim all liability for decisions made based on AI output.

8. Third-party integrations

If you connect Google Calendar, Gmail, or any other third-party service, you authorize Dagur to access that service on your behalf with the scopes you grant. Use of those third-party services is governed by their own terms and privacy policies. You can disconnect any integration at any time, which revokes our access.

9. Intellectual property

The Dagur software, design, copy, trademarks, and brand belong to us. We grant you a limited, non-exclusive, non-transferable license to use the service for personal or internal business purposes, subject to these Terms. No other rights are granted.

10. Copyright and DMCA

If you believe content on Dagur infringes your copyright, send a notice to hello@dagur.co with: (a) identification of the copyrighted work, (b) the location of the alleged infringement, (c) your contact information, (d) a statement of good-faith belief that the use is not authorized, (e) a statement under penalty of perjury that the information is accurate, and (f) your physical or electronic signature. We will respond as required by applicable law.

11. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted, secure, or error-free. To the maximum extent permitted by law, we disclaim all such warranties.

12. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or in connection with these Terms or the service, whether based on contract, tort, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total cumulative liability under these Terms or in connection with the service will not exceed the greater of (a) the total amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) one hundred euros (€100).

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Dagur and its operators from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of: (a) your use of the service in violation of these Terms or applicable law, (b) Your Content, or (c) your infringement of any third-party right.

14. Termination

  • You can stop using Dagur at any time by deleting your account from Settings
  • We may suspend or terminate your account for violation of these Terms, abuse of the service, or as required by law, with notice where reasonably possible
  • Upon termination, your access ends. Sections that by their nature should survive (ownership, disclaimers, limitation of liability, indemnification, governing law) survive termination
  • If we discontinue the service entirely, we will provide at least 30 days' notice and a way to export your data

15. Beta features

We may offer features labeled "beta," "preview," or similar. These are provided without warranty and may change or be removed at any time. Use at your own risk.

16. Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify account holders by email and post the updated Terms with a new "last updated" date at least 14 days before the change takes effect. Continued use of the service after the effective date constitutes acceptance.

17. Governing law and dispute resolution

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-laws principles. The courts of the Czech Republic have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the service, except where mandatory consumer protection law in your country of residence grants you the right to bring proceedings before your local courts.

Before filing any formal claim, you agree to first contact us at hello@dagur.co and attempt to resolve the dispute in good faith.

18. EU and UK consumers

If you are a consumer in the European Union, you may have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Nothing in these Terms limits your statutory consumer rights that cannot be waived under applicable law.

19. Force majeure

We are not liable for failure or delay in performance caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, government action, infrastructure failure, or pandemic.

20. Severability and waiver

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of our right to do so later.

21. Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms at any time, including in connection with a merger, acquisition, or sale of assets, with notice.

22. Entire agreement

These Terms, together with our Privacy Policy and any other policies referenced here, constitute the entire agreement between you and Dagur regarding the service and supersede all prior agreements on the subject.
